4. Delivery of the order
Calzados Rosi promises to deliver the product in perfect condition in the direction you indicated in the purchase process in the time period specified for each of the shipping methods after acceptance of the order barring unforeseen force majeure.
This address must be within the territory. It is the responsibility of the buyer that may be performed on the delivery address provided during working hours in which courier companies make their deliveries. In that sense, Calzados Rosi reserves the right to cancel the order if it can not forward the consignment because of the customer, when not being the same in the direction indicated on schedule, and whenever this occurs twice. In this case, Calzados Rosi must reimburse the sums paid by the customer, excluding shipping costs, which will not be refunded.
In the event that the product or products shipped have any damage to be delivered or has been delivered a product that is not requested, the client must be in communication with the Customer Service Department.

5. Guarantee and return
All items sold in CalzadosRosi.com are guaranteed under the terms provided for in Royal Decree 1/2007 of 16 November, approving the revised text of the General Law for the Defense of Consumers and Users.
Our Customer Service department is at your service to answer any questions and queries regarding our products or shipments through which we try to offer a personalized, fast and efficient attention.
If for any reason you are not satisfied with your order, you have a period of 14 calendar days from the date of delivery of the order, to change it or return it. On special occasions like Christmas, for orders placed from 20th December, the return period is extended until 15 January next year.
To exercise the right of withdrawal or refund, you must send us the products in perfect condition (unused, unwashed, with their labels without alteration) in its original container with the corresponding invoice, and the form of withdrawal and return duly completed (located in back of the invoice attached to the request), if you have lost you can download a copy (download the document here).
It is very important that you return the product(s) to us properly packaged. If the products are damaged due to improper packaging, we will not accept the return.

We will provide a Correos return label for the customer to deposit the package with the return at any Correos office.
This service has a cost of 4,90€, which will be deducted from the refund of the returned product.

4. Pick-up at your door
A courier will pick up the package with the return at the address indicated by the customer.
This service has a cost of 9,90€, which will be deducted from the refund of the returned product. This service is ONLY available at collection addresses in the Spanish mainland.
In either case, the withdrawal and return form provided by Calzados Rosi for this purpose must be duly completed, in accordance with Art.69.1 RDLg 1/2007.
In all cases the return transport costs will be borne by the customer (Art. 101.1 RDLg 1/2007).
To exercise the right of withdrawal and return or exchange, the customer must communicate their unequivocal wish to withdraw from the purchase by sending an email to firstname.lastname@example.org, by calling the Customer Service telephone number +34 91 669 80 01, or by taking the item(s) to any of the Calzados Rosi stores.
Returns that have not been previously communicated to the Customer Service Department will not be accepted.
In the event that the customer chooses to request an exchange of the article for the same article of a different size, the attention to such request will be conditioned to the availability of the article and the size requested, in the event of not being able to attend to the same due to lack of stock, the amount paid for the article will be refunded in the manner provided for in the case of returns.
In the event that the return is due to the fact that an article other than the one ordered has been sent, Calzados Rosi will pay the shipping and return costs provided that the customer notifies the company within a maximum period of 14 calendar days from receipt of the shipment, offering to replace the article with the one originally ordered or refund the amount paid if this is not possible due to lack of stock.
Once we receive the merchandise in our stores and check that all the above conditions, we will proceed to payment of the corresponding amount, which will be made within 14 calendar days, according to the method of payment we exist:
a. Payments made by credit or debit card will be credited to the same card.
b. In the case of payment by bank transfer, we will request an account number where the amount can be paid.
c. Orders paid by Paypal will be refunded to the same Paypal account.
d. Orders paid by Aplazame will be reimbursed in the same form of payment.
Once we have refunded the amount you will receive a confirmation email indicating that in a few days you will receive the corresponding amount in your account when your bank processes it (the estimated time varies depending on the bank).
In the case of a return NOT ACCEPTED because the product(s) are NOT in the same condition in which they were sent, the product(s) will remain at the customer's disposal at Calzados Rosi's facilities. If the customer wants the product(s) of the NOT ACCEPTED return to be sent back to him/her, he/she will have to pay the transport costs of the new shipment.
The articles supplied are guaranteed against manufacturing defects; in the event of a manufacturing defect in the article, the user must notify Calzados Rosi within a maximum period of two months of finding it. Once the products have been examined by Calzados Rosi's quality department, if a manufacturing defect is found to exist in the product, Calzados Rosi will confirm this circumstance to the customer by e-mail and, if the defect can be remedied, so that after repair it will be in a perfect state of use, or if on the other hand the defect cannot be remedied and the nature of the product allows it, it will offer to replace it with another identical product or refund the amount paid if the above is not possible due to lack of stock. Refunds will be made by the same payment system used by the customer. Given the seasonal nature of the articles marketed by Calzados Rosi, it is advisable for the customer to notify us as soon as possible of any incident that he/she notices in the article without exhausting the two-month period, as any delay in notifying possible manufacturing defects in the article could make it impossible to replace or rectify them at the factory.
Guarantees and after-sales services shall be governed by the provisions of Royal Legislative Decree 1/2007, of 16 November, which approves the text of the General Law for the Defence of Consumers and Users.
6. An event out of our control
Calzados Rosi is not responsible for any failure or delay in fulfilling its obligations in contracts whose cause is due to events that are beyond its reasonable control. (Force majeure).
The force majeure includes any act, event, lack of exercise, omission or accident beyond our reasonable control and among others, the following:
a) Strikes, lockouts or other industrial action.
b) Civil commotion, riot, invasion, terrorist attack, war or threat of war or war preparations.
c) Fire, explosion, storm, flood, subsidence, epidemic or another natural disaster.
d) Inability to use trains, boats, airplanes or motor transport or other means of public or private transport.
e) Inability to use public or private telecommunications networks.
f) Legislative acts of any government or public authority that limits mobility, transport and communications.
g) Strike, failure or accidents at sea, river or ground transportation or any other type of transportation.
It is understood that the obligations of Calzados Rosi under the contract shall be suspended during the period that the force majeure manifest and carry on, providing Calzados Rosi for additional time to comply with these obligations for the same period the duration of the cause of overwhelming force. Calzados Rosi will use reasonable endeavors to bring the reviewed cause, or to find a solution that would meet its obligations under the contract despite the concurrence of the force majeure.
7. Customer service and complaints
The customer satisfaction is the main concern to Calzados Rosi. Therefore, Calzados Rosi attends to any questions or complaints from their customers, as soon as it becomes aware of, pledging to meet as soon as possible. In the event that any provision of these terms is held invalid, the remaining provisions remain in full force, taking into account the will of the parties and the purpose of these General Conditions.
The non-exercise by Calzados Rosi of any right arising from the General Conditions will never be construed as a waiver of such right, which may only be express and in writing.
The General Conditions are the only express will of Calzados Rosi and its customers regarding its object, and supersedes and replaces any other agreements or arrangements that might exist between the parties, whether these verbal or written. Any modifications to these Terms must be in writing and by mutual agreement between the parties.
The Contract is binding on you and us and our respective successors and assigns. You may not transfer, assign or otherwise dispose of a Contract or any rights or obligations arising under it for or to you, without our prior written consent. For our part, we can convey, assign, sub-contract or otherwise dispose of a Contract or any rights or obligations arising under it for us or for us, at any time during the term of the Contract. For the avoidance of doubt, said transmissions, assignments, liens or other transfers will not affect the rights, if any, you have as a consumer recognized by law or cancel, reduce or otherwise limit guarantees whether express or implied, that we could have granted.
Users should not make an improper use of this website by intentionally introducing therein viruses, Trojans, worms, logic bombs or any other program or technologically damaging or harmful material; nor should conduct unauthorized access to the Website, the server on which this website is hosted or any server, computer or database related to this Web site.
